NOTICE OF PUBLIC HEARING

PLEASE TAKE NOTICE that the Town Board of the Town of Hempstead, Nassau  County, New York, will meet at the Town Hall One Washington Street, Hempstead, New York, in said Town, on December 12, 2017, at 10:30 A.M., Prevailing Time, for the purpose of conducting public hearings to consider petitions by the Hicksville Water District in said Town, for authorization to issue up to $9,200,000 refunding bonds to refund, in whole or in part, the outstanding portion of the District’s $13,000,000 Water District (Serial) Bonds, 2011 and to issue up to $21,455,000 bonds for the District’s 2017 Capital Improvement Program, which Program constitutes an increase and improvement of the facilities of Hicksville Water District within the meaning of Section 202-b of the Town Law, with an estimated maximum cost of $21,455,000, of which $1,480,395 would be chargeable against properties in the Hicksville Water District that are also in the Town of Hempstead.  The certificate of the Town Supervisor prepared pursuant to Section 102.00 of the Local Finance Law is reproduced below.

CERTIFICATE OF THE TOWN SUPERVISOR OF THE TOWN OF HEMPSTEAD, NASSAU COUNTY, NEW YORK, DATED NOVEMBER 28, 2017, IN RESPONSE TO PETITIONS BY THE HICKSVILLE WATER DISTRICT FOR AUTHORIZATION TO ISSUE REFUNDING BONDS TO REFUND  THE DISTRICT’S $13,000,000 WATER DISTRICT (SERIAL) BONDS, 2011 AND TO ISSUE UP TO $21,455,000 BONDS FOR THE DISTRICT’S 2017 CAPITAL IMPROVEMENT PROGRAM

1.       The average full valuation of the Town of Hempstead is $93,117,532,500. The most recent assessed valuation of the Town is $260,729,091. The average full valuation of the real property in the Town subject to the levy of taxes or benefit assessments by or on behalf of the Hicksville Water District is $499,745,357. The most recent assessed valuation of the real property in the Town subject to the levy of taxes or benefit assessments by or on behalf of the District is $1,399,287.

2.       The debt of the Town, prepared in accordance with Title 10 of Article 2 of the Local Finance Law, as of a date not more than thirty days previous to the date of this certificate, is $ 305,863,403.

3.       The amounts of indebtedness proposed to be contracted by the District is $9,200,000, in the case of the refunding, and $21,455,000, in the case of the District’s 2017 Capital Improvement Program. The proportionate amounts of indebtedness which would be allocated to the Town pursuant to the procedures set forth in Section 120.00 of the Local Finance Law is 6.90% of such proposed indebtedness, or $634,800 and $1,480,395, for the refunding and the District’s 2008-2013 Capital Improvement Program, respectively.  The amounts of $634,800 and $1,480,395 are 0.0068% and 0.00159%, respectively, of the average full valuation of the Town of Hempstead, and 0.12% and 0.29%, respectively, of the average full value of the real property in the Town subject to the levy of taxes or benefit assessments by or on behalf of the Hicksville Water District.

The most recent assessed valuation of the real property in the Town subject to the levy of taxes or benefit assessments by or on behalf of the District is $17,547,614.

2.       The debt of the Town, prepared in accordance with Title 10 of Article 2 of the Local Finance Law, as of a date not more than thirty days previous to the date of this certificate, is $ 771,670,000.

RESOLUTION SETTING THE TIME AND PLACE OF A MEETING OF THE INSPECTORS OF ELECTION OF THE HICKSVILLE WATER DISTRICT IN THE TOWN OF OYSTER BAY AND TOWN OF HEMPSTEAD, NASSAU COUNTY, NEW YORK

BE IT RESOLVED, by the Board of Water Commissioners of the HICKSVILLE WATER DISTRICT in the Town of Oyster Bay and Town of Hempstead, Nassau County, New York, as follows:
WHEREAS, the Board of Water Commissioners of the Hicksville Water District in the Town of Oyster Bay and Town of Hempstead, Nassau County, New York, will hold the annual election of said Water District on December 12, 2017;
WHEREAS, Section 213-a of the Town Law requires that only persons registered with the Nassau County Board of Elections on or before November 20, 2017 shall be entitled to vote in such annual election;
WHEREAS, Section 213-a permits that a resolution setting the time and place of the meeting of the election inspectors appointed by said Board of Water Commissioners of said Water District for the aforesaid general election be published;

The inspectors of election approved by resolution of said Board of Water Commissioners for the December 12, 2017 annual election, shall meet at the Water District Headquarters, 4 Dean Street, Hicksville, New York, on November 27, 2017 at 6:00 p.m. until 9:00 p.m. to commence preparation of the register of those persons eligible to vote in such annual election. Section 2. This resolution, which is effective immediately, shall be published in full in NEWSDAY, a newspaper of general circulation in said Water District, one time, at least twenty-seven (27) days before such annual election.

WHEREAS, the Board of Water Commissioners has fixed an annual election to be held on December 12, 2017;
WHEREAS, Section 212 of the Town Law requires that the annual election for the position of Water Commissioner be fixed for December 12, 2017 at a minimum between the hours of 6:00 p.m. and 9:00 p.m., prevailing time, with the Board electing to set the hours of election from 3:00 p.m. and 9:00 p.m., prevailing time, and it will be necessary to appoint inspectors for this election.

BE IT RESOLVED, that the following election inspectors are hereby designated for such purpose and designated as inspectors for registration of voters under Town Law, Section 212; namely,

RESOLUTION SETTING THE TIME AND PLACE OF THE ANNUAL ELECTION OF THE HICKSVILLE WATER DISTRICT IN THE TOWN OF OYSTER BAY AND TOWN OF HEMPSTEAD, NASSAU COUNTY, NEW YORK

BE IT RESOLVED by the Board of Water Commissioners of the HICKSVILLE WATER DISTRICT, in the Town of Oyster Bay and Town of Hempstead, Nassau County, New York, as follows:
WHEREAS, the Board of Water Commissioners of the HICKSVILLE WATER DISTRICT, in the Town of Oyster Bay and Town of Hempstead, Nassau County, New York, will hold the annual election on December 12, 2017;
WHEREAS, Section 212 of the Town Law requires that a notice be published at least once in one or more newspapers having general circulation in the District and the first publication shall be at least twenty (20) days before the day of such election;
N O W T H E R E F O R E
BE IT RESOLVED, by the Board of Water Commissioners aforesaid as follows:
Section 1. The annual election shall be held at the Hicksville Fire Headquarters Building, located at 20 East Marie Street, Hicksville, New York, and at Hicksville Fire Department Station No. 4 located at Levittown Parkway, Hicksville, New York on December 12, 2017 between the hours of 3:00 p.m. and 9:00 p.m. prevailing time in the evening. At said election the office of Water Commissioner shall be on the ballot. The office of Water Commissioner on the ballot shall be for a three (3) year term commencing on January 1, 2018 and ending on December 31, 2020.
Section 2. Qualified candidates for the position of Water Commissioner shall file with the Board of Water Commissioners a petition on the official district form containing not less than twenty-five (25) qualified voters designating the said candidate for the position of Water Commissioner and said petition shall be filed personally not later than thirty (30) days prior to the said election. Said petition must specify the office for which the candidate is running. Only those persons registered to vote with the Nassau County Board of Elections on or before November 20, 2017 will be entitled to vote at said election. Registered voters qualified to vote by absentee ballot pursuant to Section 213-b of the Town Law and other applicable laws and rules may apply for an absentee ballot at the District Office using the official district form. Such application must be received by the District Secretary at least seven days before the election day if the ballot is to be mailed to the voter, or the day before the election, if the ballot is to be delivered personally to the voter or his agent.

NOTICE OF PUBLIC HEARING
HICKSVILLE WATER DISTRICT ANNUAL BUDGET FOR 2016

WHEREAS, the Board of Commissioners of the Hicksville Water District is required to adopt a proposed annual budget for the 2016 fiscal year consisting of an estimate of proposed expenditures for and revenues of such district for next fiscal year beginning on January 1, 2016, and to hold a Public Hearing thereon on Thursday, September 3, 2015 prior to the adoption of the final annual budget for the 2016 fiscal year, pursuant to the provisions of Section 215 of the Town Law as amended, and

WHEREAS, the Board proposes to hold a Public Hearing with reference to the proposed annual budget for the 2016 fiscal year on Thursday, September 3, 2015 commencing at 6:30 p.m. at the District Office of the Hicksville Water District located at 4 Dean St, Hicksville, New York in order to provide the public with an opportunity to be heard with reference to such proposed annual budget.

WHEREAS, the Board of Commissioners has adopted the proposed annual budget for the 2016 fiscal year and has made it available for inspection on the district website at www.hicksvillewater.org and has made copies of the document available at the District Office located at 4 Dean Street, Hicksville, New York for public inspection during office hours prior to the budget hearing.

WHEREAS, a copy of the document also has been filed with and is also available for inspection at the offices of the Town Clerk of the Towns of Oyster Bay and Hempstead and on their respective websites.

NOW, THEREFORE, BE IT FURTHER RESOLVED that the Board of Commissioners of the Hicksville Water District will hold the Annual Water District Budget Hearing to be conducted with reference to the Annual District Budget for fiscal year 2016 on Thursday, September 3, 2015 commencing at 6:30 p.m. at the District Office of the Hicksville Water District located at 4 Dean St, Hicksville, New York.

NOTICE IS HEREBY GIVEN that the aforesaid budget will be presented to the residents and taxpayers of the Hicksville Water District and to the Board of Commissioners thereof, for their respective consideration at this public hearing and for the purpose of considering the said resolution and hearing all persons interested in the subject concerning same on the aforesaid date and time.
